Refractiv Limited (“Refractiv,” “We” or “Us”) respects your privacy and We are committed to compliance with the EU General Data Protection Regulation (“GDPR”) which is effective on the 25th May 2018.

This policy covers our websites as well as our products, applications and services, including OverDRIVE and Gsuitetips. By using a website, an application or service, or by purchasing, installing or using any of our products, you are consenting to our practices as described in this Privacy Policy.

Your continued use of our products, applications and services following our posting of a change notice will constitute binding acceptance of those changes. We use public or third-party lists and data for marketing purposes, where necessary with suitable permissions or consents for use. Your Personal Information may be used or processed by third-party suppliers or partners of Refractiv for our own internal business processes such as accounting, email marketing and CRM.

We collect Personal Information from people who enquire about, purchase and use our products or services. Personal Information may be provided to us in a number of ways, including through a telephone or conference call, a registration process, by completing a form, requesting support or through logging in. We may use Personal Information in order to provide product support, updates and alerts, for billing and collection and other similar purposes.

If you provide data to us belonging to yourselves or other parties, including Personal Information, through using a website, application or product provided by Refractiv, then you are the Data Controller. Depending on the service provided, such data may be backed up on a server or by using a cloud service. Backed up data may be aggregated with other similar data and require paid-for professional services activity in order to delete all or part of the data. As Data Processor, Refractiv’s responsibilities and commitments are defined within the relevant customer agreement or contract. 

We will not view or access your data except where specifically authorised or where reasonable limited access is needed as part of providing support and similar services. If you request support, it is assumed that We have express permission to access data as needed for the limited purpose of the request.  

Your Personal Information will not be shared with parties outside of Refractiv, unless otherwise required by law, court order, or other government or law enforcement authority; however, your Personal Information may be used where necessary by authorised subcontractors or partners of Refractiv for specific activities such as product support or testing. We may share aggregate, non-personally identifiable information with our business partners and other affiliated third parties (eg the number of users who have visited a site on a specific day etc.). Refractiv may match aggregated user information with third party data. Also, We may disclose aggregated user statistics in order to describe our services to potential advertisers, partners and other third parties, and for other lawful purposes.

Periodically We may contact you with business content and information about our products and services. 

If you ask us to do so and you are not a customer, We shall remove your Personal Information from our databases.

Refractiv contracts with one or more third parties to maintain and host websites and applications. Therefore, any information you submit, including Personal Information, may be placed and stored on a computer server or cloud service maintained by these third parties. As part of our security policy We use reputable suppliers and monitor their performance. Your use of our websites, products and applications and any provision of Personal Information you submit constitutes your acknowledgement that such information or content could pass through and may be stored in servers or services outside the control of Refractiv. You agree that Refractiv has no liability or responsibility for any such pass through or storage of same.

It should be noted that this Privacy Policy only addresses the use and dissemination of information that We collect from you. To the extent that you disclose any information to other parties, through other websites on the Internet linked to our websites, different policies may apply. Since Refractiv does not control the privacy policies of third parties, you are subject to the privacy customs and policies, if any, of that third party, and Refractiv shall not be responsible for the use or dissemination of your Personal Information by that third party. Therefore, We encourage you to ask questions before you disclose your Personal Information to others.

We are committed to using commercially reasonable security measures to protect your Personal Information and data. However, We cannot provide complete assurance that a breach or penetration will not occur. By continuing to use our applications, products and services you accept that it is not possible for Refractiv to guarantee the protection of your personal Information and data against external threats such as hacking, viruses and other threats. 

IP Addresses 

An IP address is a number automatically assigned to your computer whenever you access the Internet. All computer identification on the Internet is conducted with IP addresses, which allow computers and servers to recognize and communicate with each other. Refractiv does log IP addresses, or the location of your computer on the Internet, for systems administration and troubleshooting purposes. However, We do not use IP address logs to track your session or your behaviour on a website or application.

What benefits do I receive from cookies?

Overall, the use of cookies helps to give you a customised experience on websites. Through the use of cookies, We will know what’s working and what’s not. That information is then used to keep our websites fresh and relevant to you the user. Cookies also allow the personalisation of any online services We may provide to You.
